🇱🇺 Local law notes — Luxembourg
A furnished medium-stay for a corporate or nomad occupant sits between hospitality and residential letting: a genuinely short furnished let is treated flexibly, but longer residential occupation is caught by the loi du 21 septembre 2006 (reformed 1 August 2024) with its two-month deposit cap, mandatory état des lieux, once-a-year indexation, and three-month tenant / six-month landlord notice. Company-lets are common, with the employer contracting and guaranteeing in place of a cash deposit. The agreement confers no immigration right; occupants must hold valid visa/work authorisation, file the communal arrival declaration (déclaration d'arrivée), and take independent advice on tax residency.
Inside the document
1. Parties and Let Type
Identifies the landlord/operator and the occupant, and states whether this is a company-let (the employer is the contracting tenant and names an authorised occupant) or an individual let. Company-lets state the employer's liability for rent and damage.
2. Furnished Premises and Inventory
Describes the fully furnished, equipped unit and attaches a signed inventory (état des lieux) of furniture and appliances. The occupant must return items in the same condition, wear and tear excepted.
3. Term and Nature of the Let
Sets a defined medium-stay term. A short, furnished let for a mobile professional is treated more flexibly than the standard three-year unfurnished lease; the parties should state the term and its purpose. A genuinely long residential occupation may attract residential-lease protections.
4. All-Inclusive Fee
States a single all-inclusive monthly fee covering rent, charges, utilities, internet and stated services, or itemises them where preferred. Any usage caps (e.g. utilities fair-use) are specified. Rent may be indexed at most once a year.
5. Security Deposit
A deposit capped at two months' base rent (excluding charges) applies where the arrangement is a residential let, per the 1 August 2024 reform, with refunds on the statutory 50% / balance timeline. For company-lets, the employer may guarantee in place of a cash deposit.
6. Notice and Termination
Sets the notice period; for a residential let the occupant's statutory notice is three months by registered letter and the landlord's is six months on statutory grounds. Shorter contractual flexibility may be agreed for genuinely short furnished stays; early-termination terms and any break clause are stated.
7. Use and House Rules
The premises are for the named occupant's residential/work-from-home use; no subletting or additional occupants without consent. Covers quiet hours, no smoking indoors, care of furnishings, and building/co-owner rules.
8. Visa, Work and Tax-Residency Caution
The occupant is responsible for holding the correct immigration/visa and work authorisation for Luxembourg. This agreement does not confer any immigration right. Extended stays may affect tax residency and local registration (déclaration d'arrivée at the commune); the occupant should take independent immigration and tax advice.
Frequently Asked Questions
Can my employer sign the lease for me in Luxembourg?
Yes. A company-let is common for relocations: the employer is the contracting party and liable for rent and damage, while naming the employee as authorised occupant. The agreement should state the employer's guarantee, which can replace a cash deposit.
Does a furnished medium-stay give full tenant protection?
A short, genuinely furnished let for a mobile professional is treated more flexibly than the standard three-year unfurnished lease, but a long residential occupation can attract the protections of the loi du 21 septembre 2006 — including the two-month deposit cap and six-month landlord notice — so the term and purpose should be stated clearly.
Do I need to register or worry about tax residency?
Newcomers generally must file an arrival declaration (déclaration d'arrivée) with their commune, and an extended stay can affect tax residency. This housing agreement grants no immigration right, so occupants should confirm their visa/work status and take independent tax advice.
