A furnished medium-stay can be either a short residential lease under the applicable regional decree (Flanders/Brussels/Wallonia), with a two-month deposit cap, blocked-account rule, registration with FPS Finance within two months, and short-lease notice rules (in Brussels/Wallonia early tenant termination is three months' notice plus roughly one month's indemnity), or a serviced licence if it is genuinely not the occupant's principal residence. Separately, stays over 90 days generally require commune registration, non-EU occupants need the correct visa/permit, and taking up residence can create Belgian tax-residency and social-security consequences, so independent immigration and tax advice is essential.

Inside the document

1. Parties and Let Structure

Identifies the landlord/operator and either the employing company (company-let, with the named occupant) or the individual occupant, and states whether the arrangement is a short-term residential lease under the applicable regional decree or a serviced-accommodation licence, depending on furnishing, services and whether it is the occupant's principal residence.

2. The Furnished Property

Describes the furnished unit and lists furniture, appliances and equipment in an annexed inventory with a condition report (plaatsbeschrijving / รฉtat des lieux), forming the basis for any end-of-stay damage assessment.

3. Term

Sets a medium-stay fixed term (typically several months up to around three years). If structured as a short residential lease of three years or less, the regional short-lease rules apply; if a serviced licence, the agreed term and notice govern.

4. All-Inclusive Fee

States a single all-inclusive monthly fee covering rent, utilities, internet, and agreed cleaning/services, or itemises them. Where charges are provisional they are reconciled against actual cost; where truly all-inclusive this is stated as a fixed package.

5. Security Deposit

Where the arrangement is a residential lease the deposit does not exceed two months' rent and is held in a blocked account in the tenant's name or via bank guarantee (never cash); where a serviced licence, a reasonable damage deposit or card pre-authorisation applies instead, refunded promptly after check-out inspection.

6. Services and Access

Describes included services (cleaning frequency, linen, maintenance, support contact) and the operator's access rights for servicing on reasonable notice, consistent with the occupant's quiet enjoyment.

7. Occupant, Use and Conduct

Names the permitted occupant(s), restricts use to residential/remote-work occupation (not a registered business seat unless agreed), and sets house rules on guests, subletting, noise and no-smoking. In a company-let, the company remains responsible for the occupant's compliance.

8. Notice and Termination

States the notice each side gives. For a short residential lease this follows the regional decree (early tenant termination on three months' notice plus, typically, a one-month indemnity in Brussels/Wallonia); for a serviced licence the agreed notice applies. Grounds for immediate termination are listed.

Frequently Asked Questions

Is a furnished corporate stay a lease or a licence in Belgium?

It depends on the substance. If the occupant has exclusive use of the property as their principal residence, it is likely a residential lease under the regional decree with the associated deposit, registration and notice rules; a genuinely serviced, non-principal-residence stay can be a licence. The structure should be chosen and documented deliberately.

What notice applies to a medium-term furnished lease?

If it is a short residential lease of three years or less, the regional rules apply, under which a tenant early-terminating typically gives three months' notice and, in Brussels and Wallonia, pays an indemnity of about one month's rent. A serviced-licence structure instead uses the notice agreed in the contract.

Do digital nomads need to register or worry about tax in Belgium?

Stays over 90 days generally require registration with the local commune, and non-EU nationals need an appropriate visa or permit. Establishing residence can also trigger Belgian tax-residency and social-security questions, so occupants and their employers should seek independent immigration and tax advice; this agreement covers only the accommodation.
