Terms of Service

Please read these Terms of Service carefully before using HostyourBnB. These terms form a binding legal agreement between you and HostyourBnB.
1. Acceptance of terms
By creating an account or using HostyourBnB (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users — NRI property owners ("Owners") and Airbnb hosts ("Hosts").
2. The Platform's role
HostyourBnB is a marketplace that facilitates introductions between Owners and Hosts. We are not a party to any lease, sub-lease, or licence agreement between users. We do not: • Guarantee the income, occupancy rate, or performance of any listing • Verify the accuracy of property details uploaded by Owners • Act as a property manager or letting agent • Provide legal or tax advice Any agreement reached between an Owner and a Host is solely between those parties.
3. Owner responsibilities
As an Owner, you represent and warrant that: • You have the legal right to lease or sub-lease the listed property • The property is not subject to any restriction (mortgage, society by-law, court order) that prohibits sub-leasing • All property information you provide (photos, location, rent, availability) is accurate and current • You will comply with all applicable Indian laws, including FEMA, income tax obligations, and local tenancy laws • You hold or will obtain any required permissions from your housing society Owners are solely responsible for drafting and executing a valid leave-and-licence agreement with the Host.
4. Host responsibilities
As a Host, you represent and warrant that: • You are legally permitted to operate short-term accommodation in the relevant jurisdiction • You hold or will obtain any required homestay/hotel licence from the local municipality • You will comply with Airbnb's Terms of Service and Host Policies • You will not damage, alter, or sub-let the property to a third party without the Owner's written consent • You will pay the agreed rent on time and return the security deposit at the end of the tenancy Hosts are responsible for their Airbnb guests' conduct while staying at the property.
5. Subscriptions and payments
A free 7-day trial provides access to all contact features. After the trial period, Hosts must subscribe to a paid plan to contact Owners. Subscription fees are charged monthly and are non-refundable once the billing period starts, except where required by applicable law. HostyourBnB does not charge commission on rent collected between Owners and Hosts. Subscription fees are entirely separate from rental transactions.
6. Prohibited conduct
You must not: • Circumvent the Platform by connecting with another user off-Platform before a formal connection is made through HostyourBnB • Post false, misleading, or fraudulent listings • Use the Platform for any illegal purpose • Attempt to scrape, reverse engineer, or harm the Platform's systems • Share another user's personal contact details (phone, email) obtained through HostyourBnB without their consent
7. Limitation of liability
To the maximum extent permitted by law, HostyourBnB is not liable for: • Any loss or damage arising from a transaction between an Owner and a Host • Property damage, theft, or personal injury during a tenancy • Inaccurate listing information posted by an Owner • Loss of income, occupancy, or business opportunities Our total liability to any user in any 12-month period shall not exceed the subscription fees paid by that user in the same period.
8. Intellectual property
The HostyourBnB name, logo, and all Platform content (excluding user-generated listings) are the intellectual property of HostyourBnB. You may not reproduce, distribute, or create derivative works without written permission. By uploading content (photos, descriptions) to the Platform, you grant HostyourBnB a non-exclusive, royalty-free licence to display that content on the Platform and in marketing materials.
9. Governing law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.
10. Changes to these terms
We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
