🇫🇷 Local law notes — France

The bail mobilité (Loi ELAN 2018, inserted into the Loi du 6 juillet 1989) is a furnished, non-renewable lease of 1 to 10 months for people in mobility, on which no security deposit may lawfully be taken — a guarantor or the free Visale guarantee (Action Logement) is used instead. Tenant notice is one month and the landlord cannot cut the term short. Only eligible tenants qualify; otherwise a standard furnished lease (two-month deposit, one-month tenant notice) applies. Occupants should note French tax-residency triggers (broadly 183 days or main home/economic centre in France) and visa requirements for non-EU nationals.

Inside the document

1. Parties and Property

This agreement is between the landlord (bailleur) and the tenant, who may be an individual or a company taking the accommodation for an employee (company let). It identifies the furnished property and confirms the occupant.

2. Nature — Bail Mobilité

The parties adopt the mobility lease (bail mobilité) created by the Loi ELAN (2018) and inserted into the Loi du 6 juillet 1989, a furnished let of 1 to 10 months for people in professional mobility, temporary assignment, training or study. It is non-renewable; a single amendment may extend it provided the total stay does not exceed 10 months.

3. Eligibility

The tenant confirms they fall within an eligible category (professional mobility, temporary assignment/mission, training, apprenticeship, higher study, internship). If no eligible ground applies, the parties use a standard furnished lease instead, with the different notice and deposit rules that entails.

4. Term

The stay runs for the stated period between one and ten months and ends automatically at term with no renewal. The end date and any single permitted amendment are recorded here.

5. Fee — Furnished and All-Inclusive

The monthly rent is stated, with charges recovered as a fixed package (forfait de charges) so the fee is effectively all-inclusive of utilities and services as described. The property is delivered furnished to the statutory furnished-let standard.

6. No Deposit

No security deposit (dépôt de garantie) may be taken under a bail mobilité — this is prohibited by law. Any protection is instead provided through a guarantee (see below).

7. Guarantee

The landlord may require a guarantor (caution) or the free Visale guarantee from Action Logement in place of a deposit. Where a company is the tenant, the company's own covenant may serve as security.

8. Notice and Termination

The tenant may leave at any time giving one (1) month's written notice. The landlord cannot give notice to bring the fixed mobility lease to an early end; it simply expires at term.

Frequently Asked Questions

What is a bail mobilité and who can use it?

It is a furnished mobility lease of 1 to 10 months created by the Loi ELAN, for people in professional mobility, temporary assignment, training, apprenticeship, higher study or internship. It is non-renewable and ideal for relocations and eligible medium-term stays.

Can the landlord take a deposit on a bail mobilité?

No. A security deposit is expressly prohibited on a bail mobilité. Landlords instead rely on a guarantor or the free State-backed Visale guarantee from Action Logement.

Does a medium-term stay make a digital nomad tax resident in France?

It can. France generally treats a person as tax resident if they spend more than 183 days there, or if France is their main home or centre of economic interests. Non-EU nationals also need the right visa or permit. Independent immigration and tax advice is essential.
