Belgian residential-lease protection under the regional housing decrees (Flanders, Brussels, Wallonia) attaches where an occupant has exclusive possession of a home used as their principal residence, regardless of what the document is called, so a guest occupancy must keep the stay short-term and non-exclusive with the owner retaining access and control. A genuine licence to occupy is not caught by the statutory deposit, registration or notice rules, but courts assess substance over form. Any identity/contact data collected must comply with the GDPR and the Belgian Data Protection Authority.

1. Parties and Personal Licence

5. Contribution and Utilities
States any contribution the guest pays toward costs and how utilities are shared. The parties acknowledge that a modest contribution for a genuine guest stay is not intended as 'rent' creating a lease.
6. House Rules and Conduct
Sets rules on quiet hours, guests/visitors, cleanliness, no-smoking, kitchen and bathroom use, and respect for the owner and neighbours. Breach is grounds for revocation.
7. Liability and Damage
The guest is responsible for damage caused by the guest or the guest's visitors and is advised to hold personal liability insurance. The owner's liability is limited to the extent permitted by law.
8. Privacy and Data
Any personal data collected (identity, contact) is processed only as needed and in line with the GDPR and the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit / Autoritรฉ de protection des donnรฉes).

Can a guest become a protected tenant in Belgium?
Not if the stay is genuinely a short-term, non-exclusive guest arrangement with the owner retaining control and access. Belgian courts look at substance over labels, so avoid granting exclusive possession, keep the stay short-term, and do not let the property become the guest's principal residence, which could otherwise engage the regional residential-lease rules.
How much notice must I give a guest to leave?
Because a licence is not a residential lease, the statutory tenant notice periods do not apply, and the notice agreed in the document governs. Even so, the owner should act in good faith and allow the occupant a reasonable, humane period to leave to avoid a dispute over unlawful eviction.
Is a written guest agreement necessary in Belgium?
