🇱🇺 Local law notes — Luxembourg

Residential lettings in Luxembourg are governed by the loi du 21 septembre 2006 sur le bail à usage d'habitation, substantially reformed with effect from 1 August 2024. Key rules: the deposit (garantie locative) is capped at two months' base rent excluding charges; a signed entry inventory (état des lieux) is mandatory before the landlord may withhold any deposit; rent may rise only once a year in line with the cost-of-living index; the tenant's notice is three months and the landlord's is six months, both by registered letter. A short, genuinely study-linked term is acceptable but should state its reason to avoid requalification as a standard three-year lease.

Inside the document

1. Parties and Student Status

Identifies the landlord (bailleur) and the student tenant (locataire), records the student's enrolment at a named institution, and states that continued enrolment may be a condition of the tenancy. Includes contact details and the address of the let premises.

2. Premises and Term

Describes the room or unit and any shared areas. Sets the term as an academic year or semester with defined start/end dates. Note: under Luxembourg's residential lease law the standard unfurnished lease is a three-year fixed term; a genuine student let for a shorter, defined study period is treated more flexibly, and the parties should state the reason for the shorter term to avoid automatic requalification.

3. Rent, Charges and Index Review

States monthly base rent (loyer) and advance charges (avances sur charges) separately. Rent may be revised only once per year and only in line with the official cost-of-living index (indexation). Payment date and method are fixed.

4. Security Deposit (Garantie locative)

Sets the deposit at a maximum of two months' base rent (excluding charges), the statutory cap since 1 August 2024. Describes the form of guarantee and the refund schedule: 50% within one month of the exit inventory and the balance within one month of the final charges statement (décompte des charges).

5. Guarantor / Co-Signer (Cautionnement)

The parent or third-party guarantor undertakes joint and several liability for rent, charges and repair costs if the student defaults. States the guarantee amount and duration, and that the guarantor receives copies of formal notices.

6. Entry and Exit Inventory (État des lieux)

A detailed entry inventory is mandatory and must be signed by both parties; without it the landlord may not withhold the deposit for damage. A matching exit inventory is completed on departure. Normal wear and tear is excluded from deductions.

7. Use, House Rules and Conduct

The premises are for residential/study use only. Covers quiet hours, no subletting without written consent, guest and overnight-visitor limits, no smoking indoors, care of communal spaces, and respect for co-residents and neighbours.

8. Vacation Periods

States whether the student retains and pays for the room during term breaks and summer, or whether the room is released. If retained, the room remains reserved and the student may leave belongings at their own risk.

Frequently Asked Questions

Can a landlord in Luxembourg still ask a student for a three-month deposit?

No. Since the 1 August 2024 reform of the residential lease law, the deposit is capped at two months' base rent (excluding charges). A student who signed earlier and paid three months may request the difference back.

Is a guarantor normal for student rentals in Luxembourg?

Yes. Landlords routinely require a parental or third-party guarantee (cautionnement) because students often have no local income. The guarantor is jointly liable, so the clause should state the amount and duration clearly.

Must we do an entry inventory (état des lieux)?

Yes, it is now mandatory. Without a signed entry inventory the landlord cannot lawfully withhold any part of the deposit for alleged damage, so both parties should complete and sign it carefully at move-in.
