Single-sex housing is permissible under the exceptions in the Algemene wet gelijke behandeling (Equal Treatment Act) where justified by privacy or safety, but must not mask discrimination on other grounds. 1. Parties and Accommodation
This Women's Housing & Co-Living Agreement is between the Provider and the Resident, a woman occupying a private room with shared use of communal facilities at the stated address. The accommodation is offered on a women-only basis.
2. Nature of the Agreement
This is a residential room tenancy (huur van woonruimte) under Book 7 of the Dutch Civil Code, unless it qualifies as short-stay by nature (naar zijn aard van korte duur, art. 7:232 BW), in which case reduced tenant-protection rules apply. The Provider must state which basis applies. Regulated rooms are subject to the housing points system (WWS).
3. Women-Only Occupancy and Legal Basis
Occupancy is restricted to women. Single-sex accommodation is permitted under the exceptions in the Dutch Equal Treatment Act (Algemene wet gelijke behandeling / AWGB) where justified by the protection of privacy, safety or the specific character of the housing. This clause does not authorise discrimination on any other protected ground; selection among applicants is otherwise made on lawful, non-discriminatory criteria.
4. Rent, Service Charges and Included Services
The Resident pays monthly bare rent plus service charges (servicekosten) covering agreed services such as cleaning of common areas, Wi-Fi, utilities, and furnishings. The Provider gives an annual statement of service charges. Charges must be reasonable and, for regulated tenancies, may be reviewed by the Huurcommissie.
5. Deposit (Waarborgsom)
Any deposit is capped at two months' bare rent under the Good Landlord Act (Wet goede verhuurderschap) and is returned within fourteen days of departure, less only lawful deductions with written reasons.
6. Safety and Security Arrangements
The Provider maintains reasonable security measures, which may include secure entry/access control, individual room locks, lighting, and CCTV limited to common and entry areas in line with privacy law (AVG / GDPR). The Resident must keep external doors secured and not share access codes or keys with non-residents.
7. Shared Facilities and House Conduct
The Resident shares kitchen, bathroom and living areas and must keep them clean, respect quiet hours, and follow the house rules (huisreglement). Behaviour causing nuisance (overlast) or compromising other residents' safety is a breach of this agreement.
8. Visitor and Guest Policy
Visitors are permitted within stated hours and must be accompanied by the Resident. Overnight guests may be restricted or prohibited to preserve the women-only and safe character of the accommodation, as set out in the house rules. Visitors may not use the accommodation as a residence.
