Frequently Asked Questions

Is sub-leasing legal in India?

Sub-leasing is legal in India provided the original lease agreement permits it. NRI owners should ensure the sub-lease clause is explicitly included in their agreement. Some states may require registration of sub-lease agreements above a certain tenure.

Do I need to register the sub-lease agreement?

Agreements for 11 months or less typically don't require registration in most Indian states. For longer terms, registration at the local sub-registrar office is advisable. Stamp duty varies by state.

Who pays the security deposit taxes?

Security deposits are generally not taxable as income. However, interest earned on the deposit (if kept in an interest-bearing account) is taxable. Your tenant (Airbnb host) is liable for TDS at 31.2% on the monthly rent.
